Wrongful Discharge

A Kansas Wrongful Discharge Attorney –  Michael Shultz

Like most states, Kansas law follows the practice of “employment at will” which allows both employers and employees the right to terminate the employment relationship at any time, and for any reason.  However, federal and state employment laws protect employees from being terminated for illegal reasons, for example, the retaliatory discharge of whistleblowers, or firing employees with approved medical leaves of absence.  In addition, Kansas courts have created rights for employees who are terminated in violation of public policy.

Workers compensation:  In Kansas, it is illegal for an employer to fire an employee because the employee filed a workers compensation claim or had a workplace accident that might result in a claim.  You also cannot be fired for absences resulting from a workplace accident.

Whistleblowing:  In Kansas, you cannot be fired for reporting suspected violations of health and safety laws to management or to outside officials.  In Kansas, terminating someone for whistleblowing is illegal.

Employment contracts and handbooks:  In some cases, employees actually have employment contracts, and sometimes these contracts arise out of employee handbooks. Does your employer have a handbook or personnel manual. It might give you legal rights.

Anyone who has been wrongfully discharged or terminated needs an experienced attorney who understands federal and state law. The Law Firm of Kaup & Shultz, LC, has represented clients throughout Kansas in contract disputes.
