Filing a Claims With the EEOC or KHRC

In most cases, the first step in the process is to file a charge with the Equal Employment Opportunity Commission (EEOC). You can do this yourself or Kaup & Shultz, LC, can do it for you.

The EEOC claim must be filed within 300 days of the discrimination in most cases. The EEOC then has 180 days to consider your complaint. When your charge is filed with the EEOC, it will send a copy of your claim to the Kansas Human Rights Commission (KHRC). It may be advantageous for you to file a separate claim with the KHRC. Mediation or a Lawsuit?

The EEOC usually sends a discrimination claim to an independent mediator in an attempt to resolve the claim before it has to investigate the facts. If the EEOC finds that credible evidence of discriminatory behavior exists, it will try to resolve the issue with the employer through a process called conciliation. If it does not find cause to believe that discrimination occurred, it will issue a "right to sue" letter, giving you the ability to pursue your claim in federal court.
