What Is a Disability?

ADA defines disability as "a physical or mental impairment that significantly limits one or more major life activities". A disability can be a physical impairment such as being confined to a wheelchair, diabetes, a hearing disorder or carpal tunnel syndrome. Certain mental conditions may also be a disability under the law, such as depression, migraine headaches, or attention deficit disorder.

If an employee does have a disability, the employer cannot discriminate the employee based upon the disability and the employer must provide reasonable accommodation for the employee so that the employee can do his or her job. This may be a physical accommodation or something as simple as a change in job schedule, depending on the situation.

Americans With Disabilities Restoration Act

The U.S. Supreme Court restricted the applicability of the ADA in several of its decisions. In response, the ADA Amendments Act of 2008 (also referred to as the Americans with Disabilities Restoration Act) was enacted. This law takes effect on January 1, 2009, and broadly expands the ability of persons with disabilities to claim employment discrimination.
